Terms & Conditions

These Terms & Conditions (“Terms”) form a legal agreement between you and Trelegate (“Trelegate,” “we,” “us”). By accessing or using the Trelegate marketplace (the “Marketplace”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Marketplace.

Trelegate is a venue that connects customers with independent third-party professionals (“Pros”) offering services and products. We are not a party to any agreement between a customer and a Pro, and we do not perform the services or sell the products listed by Pros. Pros are independent businesses, not employees or agents of Trelegate. Any contract for work or products is solely between the customer and the Pro.

You must be at least 18 years old and able to form a binding contract to use the Marketplace. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

When you request a quote or book a visit, you authorize us to share the details needed for a Pro to respond. Quotes, prices, availability and timelines are provided by Pros and may change. Where payments are enabled, they are processed securely by our third-party payment processor (Stripe); by paying, you agree to that processor’s terms. You are responsible for paying the agreed amount for any service or product you purchase.

If you list on the Marketplace as a Pro, you represent that you hold all licenses, permits and insurance required to perform your services, and that your listings, pricing and credentials are accurate and not misleading. You are solely responsible for the services and products you provide, for responding to customers in good faith, and for complying with all applicable laws.

You may submit content such as reviews, photos, messages and job descriptions. You retain ownership of your content but grant Trelegate a non-exclusive, royalty-free, worldwide license to host, display and use it to operate and promote the Marketplace. Content must be truthful, your own, and must not be unlawful, deceptive, infringing or abusive. We may remove content that violates these Terms.

You agree not to:

• Use the Marketplace for any unlawful, fraudulent or harmful purpose.
• Post false, misleading, infringing or abusive content, or impersonate others.
• Circumvent fees, scrape data, or interfere with the security or operation of the Marketplace.
• Harass, threaten or discriminate against other users or Pros.

The Marketplace, including its design, text, graphics, logos and software, is owned by Trelegate or its licensors and is protected by intellectual-property laws. Except for content you submit, you may not copy, modify, distribute or create derivative works from the Marketplace without our prior written permission.

The Marketplace is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that listings are accurate or complete, that Pros will perform as described, or that the Marketplace will be uninterrupted or error-free. You engage Pros and purchase services and products at your own discretion and risk.

To the maximum extent permitted by law, Trelegate and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for the acts, omissions, services or products of any Pro. Our total liability for any claim relating to the Marketplace will not exceed the greater of the fees you paid to Trelegate in the three months before the claim, or US $100.

You agree to indemnify and hold harmless Trelegate and its affiliates from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Marketplace, your content, your violation of these Terms, or your dealings with any customer or Pro.

You may stop using the Marketplace at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Marketplace or other users. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability and indemnification — will survive.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Massachusetts will have exclusive jurisdiction over any dispute arising from these Terms or the Marketplace, except where prohibited by applicable law.

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above. Your continued use of the Marketplace after changes take effect constitutes acceptance of the updated Terms.
